Terms of Service — Social by The Consultant

By subscribing to Social by The Consultant (the "App" or "Service"), available at https://social.theconsultant.chat, you agree to these Terms. If you do not agree, do not use the Service. Social by The Consultant is the name of this application across all platform integrations, including Facebook, Instagram, TikTok, and Google Business Profile.

1. The Service

Social by The Consultant is a managed content service that generates branded images, videos, and captions using AI and publishes them to the social accounts you connect — your Facebook Page, your Instagram Business or Creator account, your TikTok account, and your Google Business Profile location. All posts are published from your own connected accounts using access tokens you grant us through each platform's official OAuth flow (Meta Login, TikTok Login Kit, and Google OAuth respectively).

2. Subscription & billing

  • Plans are billed monthly in advance through Lemon Squeezy, Stripe, Razorpay, Paddle, or Coinbase Commerce, depending on your region.
  • You may cancel at any time from your dashboard; access continues until the end of the billing period.
  • Each plan includes a free-post bundle that resets on the first of each month and does not roll over; additional posts draw from prepaid credit packs.
  • Failed payments trigger a 3-day grace period before the Service is paused.

3. Your responsibilities

  • You own the Facebook Page, Instagram account, TikTok account, and Google Business Profile location you connect, and you have the right to publish content on them.
  • The content you provide (text, images, logos, reference images) does not infringe third-party rights and complies with the community guidelines and terms of each platform you publish to, including Facebook Community Standards, Instagram Community Guidelines, the TikTok Community Guidelines, and Google's Business Profile content policies.
  • You review and approve each post Social by The Consultant generates before it is published.
  • If you use the BYOAI (Bring Your Own AI) feature, you are responsible for the cost and compliance of your AI provider account (Google, OpenAI, Anthropic, or other supported providers).

4. Our responsibilities

  • Social by The Consultant will post only content you have approved, at the times you have scheduled.
  • We encrypt access tokens at rest using AES-256-GCM and only use them for the purposes described in our Privacy Policy.
  • We will notify you by email if any of your connected-account tokens (Facebook, Instagram, TikTok, or Google Business Profile) become invalid so you can re-authorize.

5. Content ownership

You retain all rights to the content we generate for you. We claim no ownership over your Page, brand assets, or published posts.

6. Suspension & termination

We may suspend or terminate your Social by The Consultant account if (a) you fail to pay, (b) you use the Service to publish content that violates the community guidelines or terms of any connected platform (Facebook, Instagram, TikTok, Google), applicable law, or these Terms, or (c) any platform partner withdraws our app's approval. On termination we will delete all stored tokens and personal data as described in our Privacy Policy.

7. Disclaimers

Social by The Consultant is provided "as is". We do not guarantee uninterrupted availability of the Meta Graph API, the TikTok Display API, the Google Business Profile API, your chosen AI provider, or any specific engagement outcomes on posts.

8. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from the Service is limited to the fees you paid us in the 3 months preceding the claim.

9. Governing law

These Terms are governed by the laws of India. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts at Kochi, Kerala, India.
