Terms of Service

By subscribing to Social by The Consultant (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

We provide a managed content service that generates branded images and captions using AI, and publishes them to the Facebook Page you connect. All posts are published from your own Facebook Page using a Page Access Token you grant us through Meta Login.

2. Subscription & billing

• Plans are billed monthly in advance via Stripe.
• You may cancel at any time from your dashboard; access continues until the end of the billing period.
• Monthly post quotas reset on the first of each month and do not roll over.
• Failed payments trigger a 3-day grace period before the Service is paused.

3. Your responsibilities

• You own the Facebook Page you connect and have the right to publish content on it.
• The content you provide (text, images, logos) does not infringe third-party rights and complies with Facebook Community Standards.
• You review and approve each post we generate before it is published.
• If you use the BYOAI (Bring Your Own AI) feature, you are responsible for the cost and compliance of your Google or OpenAI account.

4. Our responsibilities

• We will post only content you have approved, at the times you have scheduled.
• We encrypt access tokens at rest and only use them for the purposes described in our Privacy Policy.
• We will notify you by email if your Facebook token becomes invalid so you can re-authorize.

5. Content ownership

You retain all rights to the content we generate for you. We claim no ownership over your Page, brand assets, or published posts.

6. Suspension & termination

We may suspend or terminate your account if (a) you fail to pay, (b) you use the Service to publish content that violates Facebook Community Standards, applicable law, or these Terms, or (c) Meta withdraws our App Review approval. On termination we will delete all stored tokens and personal data as described in our Privacy Policy.

7. Disclaimers

The Service is provided "as is". We do not guarantee uninterrupted availability of the Meta Graph API, your chosen AI provider, or any specific engagement outcomes on posts.

8. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from the Service is limited to the fees you paid us in the 3 months preceding the claim.

9. Governing law

These Terms are governed by the laws of India. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts at Kochi, Kerala, India.
